Terms of service

These terms cover your use of themochimastudio.com and the website and AI visibility services The Mochima Studio (“we,” “us”) provides to you (“you,” the client). If we sign a separate written agreement for a project, that agreement controls where it differs from these terms.

1. This website

The information on this site is general. It isn’t legal, tax or technical advice for your specific situation, and it may change without notice.

2. Quotes and scope

Every project starts with a written quote that describes the work, the price and the expected timeline. Work outside the quote is quoted separately, in writing, before we do it.

3. Payment

Payment terms, including any deposit, are stated in your quote. We may pause work while an invoice is past due.

4. Your part

• Give us accurate information about your business: name, address, phone, hours and services.
• Only send us photos, logos and text that you own or have permission to use.
• Reply to questions and review previews in a reasonable time. Delays on your side move the timeline.
• Keep your domain and the other accounts you own in good standing, unless your quote says we manage them.

5. No ranking or placement guarantees

We don’t control Google, Bing, ChatGPT, Gemini, Claude, Perplexity or any other search engine or AI tool. We don’t guarantee rankings, placement, traffic, calls, citations or mentions in any of them. Our AI visibility work makes your business information clearer and easier for those systems to read. What they show is their decision.

6. Third-party services

Your site may rely on services we don’t own, such as domain registrars, hosting, form processing and maps. Their own terms apply, and we aren’t responsible for their outages, price changes or policy changes.

7. Ownership

Content you give us stays yours. Once you’ve paid in full, you own the final site content and design we create specifically for you. We keep ownership of our general tools, templates, code and know-how, and you get a permanent license to use whatever part of them is built into your site. We may list your finished public site in our portfolio unless you ask us not to.

8. Monthly care

Monthly care is optional. What it covers, its price and how to cancel are stated in your quote.

9. Warranty and disclaimer

We’ll do the work with reasonable care and skill. Beyond that, and to the extent the law allows, the site and our services are provided “as is,” without other warranties, express or implied.

10. Limitation of liability

To the extent the law allows, our total liability for any claim related to our services is limited to the amount you paid us for those services in the 12 months before the claim. We aren’t liable for indirect or consequential losses, such as lost profits or lost business.

11. Governing law

These terms are governed by the laws of the State of Texas. Any dispute will be handled in the state or federal courts located in Harris County, Texas.

12. Changes

We may update these terms. The version posted here, with the date above, applies from that date. The terms in place when you accepted a quote apply to that project.
